By virtue of a certain execution directed to the undersigned from the Superior Court of Rutherford County in the action entitled County of Rutherford vs. PBG Holdings LLC, Robert Gullage, Patricia Gullage, I will, on September 7th, at 11:00 AM, at the Rutherford County courthouse door, in the city of Rutherfordton, sell the real property described below to the highest bidder for cash to satisfy the execution on that real property.
 
The execution was issued pursuant to judgment duly recorded in the office of the Clerk of the Superior Court for Rutherford County, in the amounts specified below.

The following described property is located in Cool Springs Township, Rutherford County, North Carolina:

Being tract three in a deed recorded on the 27th day of May, 2004 in the Rutherford County Register of Deeds, lying and being in the Town of Forest City on the West side of Hudlow Road and on the South side of Grose Street and being that certain tract of land described in Deed Book 308, Page 191, Rutherford County Registry, reference to which is hereby made and further described in Deed Book 322, Page 68; reference is also made to Deed Book 156, Page 375, all of the Rutherford County Registry and being described according to survey on September 26, 1978 by Clyde C. Sorrels, Registered Land Surveyor.

The highest bidder at public sale shall be required to pay 50% or $750, whichever is greater, of the amount of the successful bid at the conclusion of the execution sale (subject to the confirmation of the sale as by law provided). The successful bid amount shall be paid in cash or certified funds (payable to the Rutherford County Clerk of Court). The successful bidder shall also be responsible for the payment of any excise/transfer taxes due to the Register of Deeds office, and all recording fees at the appropriate time.
